Madison and Planet X settle Bell-Sports dispute

Madison and Bell Sports have settled a dispute with Planet X Limited regarding the importation by Planet X of Giro branded bicycle helmets from outside the European Economic Area into the UK.

Action was taken on the basis that the Giro helmets had been placed on the market in the UK without the consent of the trade mark owner, Bell Sports Inc. Planet X has agreed not to deal in the EEA in any helmets which infringe Bell Sports trade mark rights and to pay damages and legal costs.

Dominic Langan, chief executive of Madison, the exclusive UK distributor of Giro Helmets in the UK, said: "The unauthroised importation of Giro helmets from outside the EEA into the UK needs to stop. Significantly, these helmets may not carry a certification to the European Standard CE EN 1078, which is required for bicycle helmets sold in the UK and elsewhere in the EU."

Bell Sports and Madison have vowed to continue to police infringement of trade mark rights.
